Consumer Health Data Privacy Notice

This notice supplements the Quel Health Privacy Policy and applies to “consumer health data” as defined by the Washington My Health My Data Act, Nevada SB 370, the Connecticut Data Privacy Act's consumer health data provisions, and similar laws. It applies to residents of those states and to people whose consumer health data is collected there. It covers data not protected by HIPAA; information in your medical record is PHI governed by the Medical Group's Notice of Privacy Practices and by the standards of 42 CFR Part 2, which the Medical Group has adopted as its confidentiality policy for all patient records.
Consumer Health Data We Collect
- Information about health conditions, symptoms, treatments, or medications you express interest in or tell us about on the Platform, including screener and intake responses before they become part of a clinical record.
- Information about your use of health-related features, such as appointment requests and program enrollment status.
- Approximate location (your state) to determine where care can lawfully be provided. We do not collect precise geolocation, and we do not use geofencing around facilities that provide health care services.
- Inferences limited to operating the services, such as eligibility for a program.
Sources and Purposes
We collect consumer health data directly from you and from your use of the Platform. We collect and use it only with your consent or as necessary to provide the products and services you request: registering you, assessing eligibility, connecting you with the Medical Group, billing, customer support, security and fraud prevention, and compliance with law. We do not use consumer health data for targeted advertising. On our public marketing site, browsing and interaction data that could reveal an interest in our services is collected only as described in our Privacy Policy and, where your state's law requires consent, only after you opt in through our cookie banner. You may withdraw that consent at any time through the cookie preferences link or by sending the Global Privacy Control signal, in addition to exercising the rights below.
Sharing
We share consumer health data only with: service providers and processors bound by contract to process it solely on our instructions (hosting, electronic health record infrastructure, payment processing, communications delivery, analytics operating under our no-advertising-trackers posture); the Medical Group and its clinicians to provide your care; other health care providers and treatment organizations involved in your care when you have authorized that coordination, such as by signing a release of information; pharmacies and laboratories at your direction; and authorities where required by law. Quel Health has no affiliates and shares consumer health data with no affiliate; the categories of third parties with whom we share are listed above, and we will provide the current list of specific processors on request. We do not sell consumer health data, and we will never sell it without the separate, signed authorization those laws require, which we do not intend to seek.
Your Rights
- To confirm whether we collect, share, or sell your consumer health data, and to access it, including a list of third parties and affiliates with whom we shared it.
- To withdraw consent to our collection and sharing of your consumer health data.
- To have your consumer health data deleted.
Exercise these rights at privacy@quel.health or through Your Privacy Choices at quel.health. We will verify your request using your account or reasonable additional information, and an authorized agent may act for you with proof of authorization. We will respond within the time required by your state's law, and we will not discriminate against you for exercising rights. Withdrawing consent or deleting data may limit our ability to provide services that depend on it, which we will explain at the time.
Appeals
If we decline your request, we will explain why, and you may appeal by replying with APPEAL in the subject line to privacy@quel.health. We will respond to appeals within the period your state's law requires. If your appeal is denied, you may contact your state Attorney General: Washington (atg.wa.gov), Nevada (ag.nv.gov), or Connecticut (portal.ct.gov/ag).
